Scope and Set-up
Article 52
1.
The President
shall, on recommendations of the concerned Provincial Council, determine or
bring changes in the Organisational Divisions of the Jama’at.
2.
The Divisional set-up shall comprise of the Divisional President, Divisional
Council, and Divisional Secretary; unless the circumstances demand for some
other set-up as a temporary arrangement.
3.
Obedience of the Divisional set-up shall be binding on the Jama’at members
of the Division.

Divisional President
Article 53
A person shall be responsible for
the Divisional set-up, to be called “Divisional President”. His position
shall be of the representative of the Central President in his Division and
he shall be answerable to the Presidents of higher set-ups.
Appointment and dismissal
Article 54
The Central President shall Appoint or dismiss the Divisional
President in consultation with the Provincial President; and in doing so
shall give as much consideration as possible to the opinion of members from
the Division besides keeping in view the interests of the Jama’at. The
appointment of the Divisional President shall be for three years.
The Oath
Article 55
Before taking charge of office, the Divisional President
shall take oath before the Central President or a person or persons
appointed by him, as given in Appendix I of this Constitution.
Duties and powers of the Divisional
President
Article 56
The duties of the Divisional President shall be as follows:
1. Spread of the Jama’at’s
Call, mission, policies and program in the Division, and to take necessary
steps for their realisation.
2.
Carrying out higher
set-ups’ directives and arrange for timely payment of their dues.
3.
Keeping the higher
set-ups informed of conditions in the Division and of the work of Jama’at in
it.
4.
Supervision, guidance and
accountability of the subordinate units, departments and institutions and
their staff and workers in the Division.
5.
Taking timely notice and
steps on issues pertaining to or affecting the mission and objective of the
Jama’at in the Division.
6.
Execution of
duties and responsibilities as may be assigned by the higher set-ups.
Article 57
The powers of the Divisional President shall be:
1.
Appointment and
dismissal of the Divisional Secretary in consultation with the Divisional
Council.
2.
Appointment and
dismissal of personnel in Divisional Departments.
3.
Convening the
sessions of Divisional Council and meetings.
4.
Expending from the
Divisional Fund according to the budget approved by the Divisional Council,
and takes appropriate and necessary steps for performing his duties
according to the Constitution.
5.
Exercise of powers
that the higher set-ups’ Presidents may delegate to him.
3.
Divisional Council
Composition and Tenure
Article 58
1.
Every Divisional Council shall be elected directly by the Jama’at members of
the Division.
2.
The number of the members to the Divisional Council shall be determined by
the Divisional President.
1.
The members of the
Divisional Council shall be elected for two years.
4.
The Divisional President shall be the Chair and the Divisional Secretary
ex-officio member and secretary of the Divisional Council.
Inaugural session
Article 59
The Divisional President shall convene the inaugural session
of the new Council within one month of the election, where every member
shall individually take the oath before the Divisional President as given in
Appendix 2 of this Constitution. Afterwards, the Divisional President shall
apprise them about their duties and responsibilities as well as prevalent
situation and state of affairs of the Jama’at in the Division.
Relationship between the
Divisional President and the Divisional Council
Article 60
1. Except for the day-to-day affairs, the
Divisional President shall decide on all the important matters in
consultation with the Divisional Council.
2. In case of discord between the Divisional
President and his Council, the case shall be referred to the Presidents of
higher set-ups.
The Session
Article 61
There shall be two ordinary sessions of the Divisional
Council in a year.
Article 62
Extraordinary session of the Divisional Council may be called
any time under the following conditions:
a. The Divisional
President considers it necessary.
b.
At least 3 of the
Divisional Council’s members requisition it in writing.
c. The Divisional Department for
Organisational Affairs, in case of absence of the Divisional President,
finds it necessary.
d.
The Presidents of
higher set-ups order to convene it.
Duties and Powers
Article 63
The duties of the Divisional Council shall be as are stated
in the oath of membership of the Council (Appendix 2), and the powers of the
Council shall be as follows:
1.
Giving expression
to opinion through the passage of resolutions or statements on issues
pertaining to and affecting the mission and objectives of the Jama’at,
provided that they are not against any general or specific policy of the
higher set-ups.
2.
Accountability of
the performance of the Divisional Jama’at and subordinate units.
3.
Approval of the
divisional budget.
4.
Adoption of
confidence or no-confidence resolution for or against the Divisional
President.

Divisional Secretary
Appointment and dismissal
Article 64
The Divisional President shall appoint the Divisional
Secretary in consultation with his Council who shall remain in office as
long as the Divisional President is satisfied with his work.
Duties
Article 65
1.
The Divisional
Secretary shall be the aide and representative of the Divisional President
in all matters of the Jama’at in his Division, and shall execute the duties
assigned to him by the Divisional President and shall be answerable to him.

2. Before taking charge of
office, the Divisional Secretary shall take oath of office as given in
Appendix 3 of this Constitution.
